Double Opt-In

Double opt-in is a two-step consent process in which users must actively confirm their subscription to a newsletter or messaging channel – the most legally robust standard for GDPR-compliant marketing.

What is Double Opt-In?

Double opt-in (DOI) is a two-step sign-up process: the user initially provides their contact details (step 1 – first opt-in), then receives a confirmation message and must actively confirm their consent by clicking a link or sending a reply (step 2 – confirmation). Only after this second step is the contact added to the subscriber list.

The alternative – single opt-in – adds contacts immediately after the initial sign-up without an additional confirmation. Single opt-in is faster but legally riskier and typically leads to lower list quality due to typos and fake submissions.

Why is Double Opt-In Important for GDPR?

The General Data Protection Regulation (GDPR) requires businesses to be able to demonstrate consent for marketing communications at any time (Art. 7 GDPR). Double opt-in reliably satisfies this burden of proof: the timestamp of confirmation, IP address, and method used are all recorded.

Without double opt-in, businesses risk:

  • Fines from data protection authorities (up to €20M or 4% of annual revenue)
  • Cease-and-desist actions from competitors or consumer organizations
  • Suspension of the WhatsApp Business API account by Meta

For WhatsApp newsletters, Meta itself recommends the double opt-in process, as WhatsApp accounts can be suspended if they receive too many spam reports.

The Double Opt-In Process

The typical flow for a WhatsApp newsletter:

  • Step 1 – Sign-up: The user enters their phone number on a landing page, in a widget, or via a click-to-WhatsApp ad and confirms the privacy notice
  • Step 2 – Confirmation message: An automated WhatsApp message is sent: "Would you like to subscribe to our newsletter? Reply YES." or with a confirmation link
  • Step 3 – Confirmation: The user replies or clicks – only now is the contact saved as an active subscriber
  • Logging: Timestamp, channel, and confirmation method are automatically stored in the system

The legal foundation for marketing communications under GDPR:

  • Art. 6(1)(a) GDPR – Consent as the lawful basis for processing
  • Art. 7 GDPR – Conditions for consent (freely given, specific, informed, unambiguous)
  • ePrivacy Directive – Requires prior consent for electronic marketing communications
